Kitabh Platform
Article 1: Confidentiality
Confidentiality covers all information referred to as "Confidential Information." This includes proprietary, private, non-public, or sensitive materials and information disclosed to you, whether directly or indirectly, or obtained orally, in writing, graphically, or in electronic or other formats, pursuant to or as a result of agreeing to the Service User Terms. This also encompasses all services we provide and defines how we collect, use, and disclose information regarding users of the "Kitabh" platform.
Throughout the duration of your use of our platform, you may receive non-public information regarding us or the available services. Accordingly, you must adhere to the following:
- Protective Measures: Take all necessary and reasonable measures to protect and maintain the confidentiality of all Confidential Information and use it only to the extent necessary to participate in the services.
- Non-Disclosure: Commit not to reveal, disclose, use, make available, or copy any Confidential Information to any other person or third party without obtaining our prior written consent.
- Ownership: Agree that all Confidential Information remains our exclusive property.
- Publicity & Branding: No public announcement or statement regarding the platform's services, name, trademark, or logo may be issued in any form without our prior written consent.
- Professional Conduct: Commit not to misuse the services or exaggerate the existing relationship between us in any manner.
Note: You have the right to disclose information to any government entity requesting it, provided that sufficient prior written notice is given to us to allow us to challenge such disclosure.
Article 2: Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia. In the event of any dispute, it shall be resolved amicably within 30 days from the date the dispute arose. If an amicable solution cannot be reached, the competent courts in the city of Riyadh shall have jurisdiction to settle the dispute.
Article 3: Suspension of Service or Account Closure
You acknowledge that your use of the "Kitabh" platform services is at our discretion. If you fail to comply with these Terms and Conditions, we may, at our sole discretion, freeze your account.
We reserve the right to prevent you from making any service bookings, cancel existing bookings, and/or bar you from using our platform, customer service, or your account. We will only exercise this right if there is, in our opinion, a valid reason, including but not limited to:
- Fraud or Abuse: Any deceptive practices or misuse of the platform.
- Non-Compliance: Failure to adhere to our values, applicable laws, or regulations.
- Inappropriate Behavior: Illegal or improper conduct (such as violence, threats, or privacy violations) toward us, our partner companies, or any other party.
If a booking is canceled as a result of the above, you will not be entitled to a refund. We may inform you of the reason for cancellation unless doing so (a) violates applicable laws or (b) hinders the detection or prevention of fraud or other illegal activities. If you believe your booking was canceled incorrectly, please contact our Customer Service team.
Article 4: General Provisions
- Survival of Terms: Provisions regarding disclaimers, warranties, limitations of liability, indemnity, intellectual property, and governing law shall remain in effect after the termination of these terms.
- Integral Part: All materials mentioned above are considered an integral part of the platform's Terms and Conditions.
- Third-Party Rights: No person who is not a party to these terms has the right to enforce them, except for our affiliates (if any).
- Entire Agreement: These Terms and Conditions supersede all prior written or oral agreements.
- Disclaimer of Liability: Use of this service is at your own risk. We are not liable for any loss or damage resulting from your use of the service, reliance on any statement, opinion, or advertisement, operation delays, connection failures, internet access issues, software issues, or the conduct of any person accessing the service.
- Exclusive Remedy: You agree that your sole and exclusive remedy for any damage or loss resulting from the use of this service is to cease using it.
- Prohibited Content: You pledge not to use the platform to incite sectarianism or post content that includes:
- Insults to religions, beliefs, or religious symbols.
- Political content or content related to political organizations, parties, or conflicts.
- Incitement to hatred, discrimination, racism, or intolerance in any form.
- Personal attacks, bullying, or direct abuse of any individual or group.
- Prevailing Language: If these terms are translated into any other language, the Arabic version remains the primary reference for interpretation.
- Account Updates: You agree to provide current information and update your account details, including but not limited to your email address.
