Kitabh Platform

These terms and conditions apply to all users of the website or the "Kitabah" platform operated by the Kitabah Publishing Platform (the "Platform"), which is provided to platform users ("Customers"). Accessing the Platform constitutes the user's agreement to these terms and conditions and to any other relevant policies and notices, collectively referred to as the "Terms and Conditions."

Your use of the Kitabah Platform is subject to these Terms and Conditions and to the laws and regulations of the Kingdom of Saudi Arabia. These Terms and Conditions set out how you may use our services, as well as the rights and obligations of all parties. To use the platform/website properly, you must create a (User) account. These Terms apply from the date of your first registration on the platform/website.

The following terms have the meanings set out below whenever they appear in these Terms and Conditions:

  • Platform: Refers to the "Kitabah" platform and all content and services available through it.
  • User: Refers to platform users who interact with the service providers.
  • Services: Refers to the services provided by the service provider.
  • Website: Refers to Kitabah's website: kitabh.com.
  • Applicable Platform Laws: Refers to the laws in force in the Kingdom of Saudi Arabia.

Introduction

Welcome to "Kitabah," a digital Arabic social platform dedicated to helping writers compose, publish, and market their texts online, in addition to creating newsletters and personal blogs and interacting with others' content. Registration for our services is available to any user inside or outside the Kingdom of Saudi Arabia in accordance with these Terms and Conditions, and your membership will be activated as soon as you register with us.

First: Terms of Use

Your access to these Terms and Conditions is deemed your agreement to abide by them and by any other terms published and updated on the "Kitabah" Platform. Please read these Terms carefully before using the services of the "Kitabah" Platform.

If you do not agree to these Terms and Conditions, please do not use the website, its services, or applications. Additional terms may sometimes be added, so please review this page periodically for any changes. You acknowledge that it is your responsibility to review these Terms and Conditions periodically to stay informed of updates, and you waive any right to receive specific notice of each change. Your continued use of the website and the Platform after the date the revised Terms and Conditions are published constitutes your acknowledgment that you have read, understood, and agreed to be bound by the amendments.

Second: Creating Your Account

Registration on the Platform is free, in addition to monthly subscriptions for some services. To become a registered user, you must create a "User" account with us in accordance with the conditions and requirements set out below. You must not register under an alias and/or impersonate another user's login credentials or password(s). Such fraudulent behavior violates applicable international and national laws and regulations in force in the Kingdom of Saudi Arabia.

Account Creation Requirements

When creating an account, you must provide the following information:

  • Your name.
  • Your email address.
  • A contact number.
  • A brief bio of the writer or reader for identification.

Our services on the Platform include:

  • Creating a personal website for the writer and launching their newsletter.
  • Browsing and interacting with texts published by writers.
  • Publishing the writer's own articles.
  • Proofreading Arabic texts using AI.
  • Converting written texts into audio content.
  • Providing all tools that help writers draft and publish their articles and writings.

Third: Password

If you choose, or are provided with, a username or password or any other information as part of our security procedures, you must treat such information as strictly confidential. You are solely responsible for maintaining the security of your password and may not disclose it to third parties.

You are solely responsible for any use of or action taken under your password. If your password is compromised, lost, or stolen, or if you believe there is unauthorized access to your "Kitabah" account, you must change your account password and notify us immediately. The customer is responsible for any transactions made using a stolen account unless they promptly notify us to suspend the account. We have the right to disable any user ID or password at any time if, in our reasonable opinion, you have failed to comply with any of these Terms.

Fourth: Specific Policies

By creating a valid user account, you agree to abide by these Platform/website Terms as well as all policies, protocols, guidelines, and other terms on the Platform/website, including:

  • Any terms specific to the Kingdom of Saudi Arabia that we may notify you of from time to time.
  • Any terms specified for each service selected, such as the obligation to provide accurate information required for registration.
  • Any special terms and policies.

Fifth: Legal Responsibility

The "Kitabah" Platform reserves the right to disclose your personal identifying information, including when we deem such disclosure necessary to the Platform/website or to payment processors, to enforce our Terms and Conditions, to protect our legal rights, and/or to comply with any judicial process, court order, or legal proceedings on the Platform, or as required by law or a competent authority.

Sixth: Payment and Settlement for Users

  • Service fees related to financial services are predetermined and clearly stated on the Platform for each service.
  • An electronic payment gateway is used.
  • Fees are paid after choosing a subscription plan; payment is therefore in advance.
  • All payments are in Saudi Riyals. If the user pays in another currency, the user bears the costs and fees for currency conversion or any other bank charges.
  • If a subscription plan is chosen and the service provider cannot collect the balance on the due date, the provider may cancel the service without notice.
  • Paid plans on the Platform operate on a subscription basis (monthly or yearly) with auto-renewal, whereby the amount is automatically charged to the registered payment method unless the user cancels before the renewal date.
  • The user is responsible for managing their subscription, and continued subscription constitutes implicit consent to automatic charges.

Seventh: Disclaimer

The "Kitabah" Platform provides financial services to the user "as is," and any requested service outside the scope of the Platform remains solely the user's responsibility. The Platform bears no liability under any circumstances.

The Platform disclaims all liability for any indirect, incidental, or consequential damages arising from your use of our services. All information stated on our Platform is provided for information and general knowledge only and is not certified data. All services and writings affiliated with us may not be republished, photographed, or recorded and are considered the exclusive property of the publishing writers.

Eighth: User Obligations

  • Comply with all policies and procedures, these Terms and Conditions, and any guidance or restrictions issued by the Platform/website support team.
  • Follow any notifications sent through the Platform/website relating to services provided by "Kitabah."
  • Not claim any relationship with or representation of any company, partnership, or institution unless legally authorized by us to do so.
  • Not engage in activities that violate laws or others' rights.
  • Notify us of any unauthorized use of the account on the Platform/website and report any other security breach via our official communication channels.
  • Preserve all content and secret numbers for accessing their account securely.
  • Maintain the confidentiality of our data.

Ninth: User Warranties and Representations

The user represents and warrants that:

  • You have full authority to agree to these Terms and will at all times fully comply with all applicable laws, regulations, and legislation.
  • You have the legal capacity and competence to use the various Platform/website services.
  • All information you provide must comply with the applicable regulations in the Kingdom of Saudi Arabia.
  • You acknowledge that you are solely responsible for any information submitted through the Platform and for any violation involving third parties.

With respect to misuse of the Platform/website, you acknowledge that you may not:

  • Use the website to post any abusive, inaccurate, misleading, defamatory, fraudulent, or illegal information or content.
  • Use any tools or methods that disable or manipulate the Platform (strictly prohibited).
  • Disrespect readers and other writers; please interact politely and courteously in comments or replies.
  • Engage in unfair professional or commercial practices and/or post any advertising or inaccurate or misleading information through the Platform.

We reserve the right, at our sole discretion, to remove any content from the Platform and to terminate your registration or membership and restrict your access to our services at any time and for any reason.

Tenth: Correspondence and Electronic Communication

By creating an account, you acknowledge and agree to communicate with us electronically, and therefore agree to receive periodic messages from us. The "Kitabah" team will contact you by email or may send you information via SMS or WhatsApp, and may post notices on the website as part of normal business operations connected to your use of the services.

To ensure we can communicate with you electronically, you agree to promptly notify us of any change in your email address or any other information through which we contact you, including your phone number, by updating your identifying information as soon as reasonably possible.

You acknowledge and agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Eleventh: Services Provided Within the Platform

The "Kitabah" Platform will always strive to provide you with the best services to improve your writing and publishing experience, including notably:

  • Programs to multiply writing productivity.
  • Courses to improve writing.
  • Enabling wide-reach posting.
  • Creating a dedicated website for the writer.
  • Launching a newsletter.
  • Publishing content and using proofreading tools and converting texts into listenable audio files.

Thirteenth: Additional Restrictions

  • The "Kitabah" Platform reserves the right to accept or reject your membership at its sole discretion.
  • We may from time to time choose to add or remove membership benefits at our sole discretion and delete content submitted by you if you fail to comply with these Terms and Conditions.
  • If you cancel the service or stop your account, any fees paid in advance are non-refundable.
  • Any misuse by the user outside the scope and purpose of benefiting from the Platform/website will lead to immediate account suspension.
  • Service is performed based on the documents and facts provided by the user; if the user conceals any of them, we bear no responsibility for the resulting error.

Fourteenth: Amendments

The "Kitabah" Platform/website reserves the right to change, modify, add to, or remove parts of these Terms and Conditions at its discretion at any time and without prior notice.

Any violation of these Terms and Conditions may result in suspension of your account without prior notice and without refund of any amounts in some cases. It is your responsibility to periodically review our electronic application for changes. Your continued use of or access to our application or service after any changes to these Terms are posted constitutes acceptance of those changes.

Fifteenth: Indemnities

By using our application, you release and agree to indemnify and hold us harmless to the maximum extent permitted by law from any claim, loss, damage, settlement, cost, expense, or other liability arising out of or in connection with:

  • Your actual or potential violation of any of the obligations set out in the Platform/website Terms of "Kitabah."
  • Any other means by which you expose the Platform, service users, or service providers to harm under the applicable laws of the Kingdom of Saudi Arabia.

Sixteenth: Intellectual Property Rights and Trademark

All content published on the "Kitabah" Platform by users (including texts, articles, creative materials, and others) remains fully owned by its authors. The writer retains full copyright and intellectual property rights to their content, with no transfer of ownership to the Platform.

The writer grants the "Kitabah" Platform a limited, non-exclusive, non-sublicensable license to display and distribute the content within the Platform only and for the purpose of operating its services, without modification or commercial use outside the Platform unless expressly agreed in advance with the writer.

The writer has the right to publish the same content on any other website or platform as they see fit, without any restrictions from the "Kitabah" Platform. The writer also has the right to delete the content from the Platform at any time, which will automatically terminate the license granted.

No other user may copy, distribute, reuse, or display any content published on the Platform without the express permission of the original content owner.

Seventeenth: Force Majeure and Risk of Loss

We are not responsible for any delay or failure to perform any obligations under these Terms and Conditions when caused by events or circumstances beyond our reasonable control.

Eighteenth: Downtime and Protection Against Viruses

We make every effort to scan and test our Platform's contents at every stage, and we advise you to always run antivirus software on all materials downloaded from the internet. We are not responsible for any loss, interruption, or damage to your data or computer that may occur while connecting to this Platform or when using any material from it.

We do everything necessary to keep the "Kitabah" Platform and our website operating continuously and without interruptions. If a malfunction or fault appears on the Platform or website, we will take all necessary steps to fix it immediately. If we notice abnormal use from your account, we will suspend the account until we verify the nature of the activity originating from it.

Nineteenth: Eligibility and Legal Age

The service is not available for use by persons under the legal age of 18 years. You must have reached the age of majority under the legal system to which you are subject and be fully capable and competent to agree to these Terms and Conditions and the obligations, undertakings, and warranties set out herein, and to abide by them.

Twentieth: Confidentiality

Confidentiality covers all information referred to as "Confidential Information," meaning private, confidential, non-public, or proprietary materials and information disclosed to you directly or indirectly, or obtained orally, in writing, graphically, electronically, or otherwise under or as a result of the service user terms agreement.

You may receive information related to us or to the services available during your use of our Platform that is not publicly disclosed. Accordingly, you must:

  • Take all necessary and reasonable measures to protect and maintain the confidentiality of all Confidential Information and use it only to the extent necessary to engage with the services.
  • Not disclose, reveal, use, make available, or copy any Confidential Information to any person or third party without our prior written consent.
  • Agree that all Confidential Information is our exclusive property.
  • Not issue any announcement or public statement related to the Platform's services, our name, trademark, or logo in any manner without our prior written approval.
  • Refrain from misusing the services or overstating the relationship between us in any manner.

You may disclose information to any government entity that requests it, provided that appropriate written notice is given to allow us to challenge such disclosure.

Twenty-first: Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. In the event of any dispute, it shall be resolved amicably within 30 days from the date the dispute arises between the parties to the extent possible; if not resolved, the dispute shall be submitted to the competent court in Riyadh.

Twenty-second: When We May Suspend Your Use of the Services or Close Your Account

You acknowledge that your use of the "Kitabah" Platform services is at our discretion, and if you fail to comply with these Terms and Conditions, we may, at our sole discretion, freeze your account.

We may prevent you from making any booking for services and/or cancel any booking you have already made, and/or prevent you from using our Platform and/or our customer service and/or your account. We will only do so if, in our opinion, there is a good reason, including but not limited to:

  • Fraud or misuse.
  • Non-compliance with our values or with applicable laws or regulations.
  • Improper or illegal behavior (such as violence, threats, or invasion of privacy) toward us, any of our partner companies, or anyone else.

If we cancel a booking as a result, you will not be entitled to a refund. We may tell you why we canceled your booking unless doing so (a) would violate applicable laws and/or (b) would prevent or hinder the detection or prevention of fraud or other illegal activities. If you believe we canceled your booking in error, please contact our customer service team.

Twenty-third: General Provisions

The provisions of these Terms and Conditions relating to disclaimers of representations and warranties, limitations of liability, indemnification obligations, intellectual property, and governing law shall survive termination of these Terms.

All of the above provisions are an integral part of the Platform's Terms and Conditions. No person who is not a party to these Terms and Conditions shall have the right to enforce any of them, except for our affiliates, if any. All these Platform Terms and Conditions supersede all prior written or oral agreements.

Your use of this service remains at your own risk, and we are not, under any circumstances, liable for any loss or damage of any kind that you may incur due to your use of the service, or your reliance on any statement, opinion, or announcement on the service, or arising from any delay in operation, connection difficulties, internet access problems, software, or the conduct or ideas of any person accessing this service.

You hereby acknowledge and agree that your sole and exclusive remedy for any damage or loss that may result from your access to or use of this service is to refrain from using or accessing it or to discontinue doing so.

You undertake not to use the Platform to incite sectarian slogans and to avoid publishing any content that includes:

  • Insulting religions, beliefs, or religious symbols.
  • Political content or content linked to organizations, parties, or political conflicts.
  • Incitement to hatred, discrimination, racism, or intolerance of any kind.
  • Personal attacks, bullying, or direct abuse of any person or group.

If these Terms and Conditions are translated into any other language for any reason, the Arabic text shall be the basis and reference for interpreting these Terms and Conditions.

You agree to provide up-to-date information and agree to update your account and any other information, including but not limited to your email address.
